These terms and conditions ("Terms", "Agreement") are an agreement between Styldod, Inc. (“Styldod, Inc.”, “us”, “we” or “our”) and you (“User”, “you” or “your”). This Agreement sets forth the general terms and conditions of your use of the Styldod website and any of its products or services (collectively, “Website” or “Services”).
We encourage you to review this Agreement carefully. By accessing or using the Styldod Website in any way, you are agreeing to these Terms in their entirety. If you do not agree to any of the Terms, you may not use the Styldod Website.
1. Using the Styldod Website
a. Who can use it:
You must be at least the age of majority in the state where you live to use the Styldod Website. Use of the Styldod Website by anyone under 16 years of age is strictly prohibited!
b. Registration:
Access to certain functionalities of the Styldod Website will require you to register with us and to create a profile on our Website. If you register with Styldod, you agree to provide us with accurate information and update it as needed for accuracy. We will treat personal information you provide as part of registration in accordance with our Privacy Policy.
c. Privacy Policy:
Our privacy practices are set forth in our Privacy Policy. By using the Styldod Website in any way, you understand and acknowledge that the terms of the Privacy Policy apply to you, regardless of whether you have created an account on Styldod.
d. Acceptable Use Policy:
When using the Styldod Website, you agree to abide by common standards of etiquette and act in accordance with the law, as described further in our Acceptable Use Policy.
e. Termination:
You may close your account at any time by going to account settings and deactivating your account. We may permanently or temporarily suspend your use of the Styldod Website at any time for any reason, without any notice or liability to you. We may terminate your account at any time for any or no reason, including if you violate any Styldod policy.
f. Feedback:
We welcome your feedback and suggestions about how to improve the Styldod Website. Feel free to submit feedback at help@styldod.com. By submitting feedback in this or in any other manner to us, you grant us the right, at our discretion, to use, disclose and otherwise exploit the feedback, in whole or part, without any restriction or compensation to you.
g. Permitted and Prohibited Uses:
You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services in any way that violates any applicable federal, state, local or international law or regulation. You also agree not to:
i. Use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party's use of the Site.
ii. Use any robot, spider or other automatic device, process or means to access the Site for any purpose, including monitoring or copying any of the material on the Site.
iii. Use any device, software or routine that interferes with the proper working of the Site.
iv. Introduce any viruses, Trojan horses, worms, logic bombs or other material which is malicious or technologically harmful.
v. Attempt to gain unauthorized access to, interfere with, damage or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer or database connected to the Site.
vi. Attack the Site via a denial-of-service attack or a distributed denial-of-service attack.
vii. Attempt to bypass methods Styldod may use to prevent or restrict access to the Site or Services.
viii. Otherwise attempt to interfere with the proper working of the Site.
ix. Use the Site or Services for any purpose competitive to the Styldod services, or for the purpose of disparaging the Services.
x. Scrap or copy profiles and information of other Site users through any means (including crawlers, browser plugins and add-ons, and any other technology or manual work) for any purpose whatsoever.
xi. Market, sell, transfer, or otherwise make available to any other person or entity any data collected from, or derived from data collected from, the Site, for any commercial, political, market surveying or other purpose, whether in aggregated or bulk form or otherwise.
xii. Any content, information or other materials you post or upload to the Site, and you bear all risks associated with the use of the Site.
2. Content
a. Your Content:
In the use of the Services provided by Styldod, you shall have the ability to provide Input to the Services, and receive Output generated by the Services based on that Input. The combination of input and output shall constitute "Content". Ownership of all Input shall reside with you. Styldod hereby assigns to you all rights, title, and interest in and to the Output generated by the Services, subject to your compliance with these Terms. This assignment of rights includes the ability to use the Content for any purpose, including commercial purposes such as sale or publication, provided that such use is in accordance with these Terms. Styldod reserves the right to use Content for its own purposes, including to provide and maintain the Services, comply with applicable law, and enforce its policies. You shall be solely responsible for ensuring that any Content you provide does not violate any applicable law or these Terms.
b. Similarity of Content:
It is important to understand that, due to the nature of machine learning, the Output generated by the Services may not be unique across users. It is possible that the same or similar Output may be generated for other users or for Styldod or a third party. For instance, if you provide input to a model to “change the color of a wall to blue”, the Output you receive may be "Blue colored wall". Other users may provide similar inputs and may receive the same or similar Output. Please note that any responses generated for other users are not considered your Content.
c. Use of Content to Improve Services:
We may use Content that you provide to develop or improve our Services.
d. Accuracy:
The fields of artificial intelligence and machine learning are constantly evolving, and we strive to improve our Services to ensure they are accurate, reliable, safe, and beneficial. However, due to the probabilistic nature of machine learning, the use of our Services may result in incorrect Output that does not accurately reflect real people, places, or facts. It is important that you evaluate the accuracy of any Output for your intended use case. This evaluation may include human review of the Output.
e. Use of Copyright free content
As between you and REimagineHome you own the Content that you generate using the platform to the extent permitted by applicable law.
With respect to images you upload to the platform, you represent and warrant that you own all right, title, and interest in and to such images, including without limitation, all copyrights and rights of publicity contained therein. You are responsible for the Content, including for ensuring any Content Sharing does not violate any applicable law, intellectual property right of any third party, or these Terms.
You agree that REimagineHome and our affiliates may use the Content to develop and improve the platform, including by storing your Content and associated metadata (i.e., image specifications, seeds, and text prompts) in a “history” section of your account so that you may browse and retrieve Content you previously have generated using the Services.
f. Watermark content:
Altering and Removing watermarks on the outputs generated by REimagineHome.AI will be considered as legal offence and we hold the right to all the images.
g. Use of content
When you download a image on REimagineHome, you're buying an image that lets you use the image for any personal, business or commercial purposes. That means you can use our content in advertising, marketing, apps, websites, social media, TV and film, presentations, newspapers, magazines and books, and product packaging, among hundreds of other uses.
3. Disclaimers and Limitations of Liability
Please read this section carefully since it limits the liability of Styldod entities to you.
The "Styldod entities" means Styldod Inc. , suppliers, licensors and partners, and the officers, directors, employees, agents and representatives of each of them. Each provision below applies to the maximum extent permitted under applicable law:
a. We are providing you the Styldod Website, services, information, products, product descriptions, and third-party content on an "As is" and "As available" basis, without warranty of any kind, express or implied. Without limiting the foregoing, the Styldod entities expressly disclaim any and all warranties and conditions of merchantability, title, accuracy and completeness, uninterrupted or error-free service, fitness for a particular purpose, quiet enjoyment, and non-infringement, and any warranties arising out of course of dealing or trade usage.
b. The Styldod entities make no promises with respect to, and expressly disclaim all liability, to the maximum extent permitted by law, for: (i) content posted by any third-party on the Styldod Website, (ii) the product descriptions or products, (iii) third-party sites and any third-party product or service listed on or accessible to you through the site, (iv) plants or seeds from the exchanges, and (v) the quality or conduct of any third-party you encounter in connection with your use of the site.
c. You agree that under the maximum extent permitted by law, the Styldod entities will not be liable to you under any theory of liability. Without limiting the foregoing, you agree that the Styldod entities specifically will not be liable for (I) any indirect, incidental, consequential, special, or exemplary damages, loss of profits, business interruption, reputational harm, or loss of data (even if the styldod entities have been advised of the possibility of such damages or such damages are foreseeable) arising out of and in any way connected with your use of, or inability to use, the Styldod Website or products.
4. Payment
You shall pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. If, in our judgment, your purchase constitutes a high-risk transaction, we will require you to provide us with a copy of your valid government-issued photo identification, and possibly a copy of a recent bank statement for the credit or debit card used for the purchase. We reserve the right to change products and product pricing at any time. We also reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.
a. Security: We employ industry-standard security measures to protect against the loss, misuse, and alteration of the information under our control. Although we make good faith efforts to store the information collected by the website in a secure operating environment, we cannot guarantee complete security.
b. Payment Terms: Upon making a purchase, you agree that you are authorized to use the designated payment method and you authorize us to charge your order (including taxes, and any other amounts described on the Websites) to that payment method.
c. Taxes: Applicable taxes will be added to the purchase price on all taxable items.
d. Changes to Payment Terms: We reserve the right to change our payment procedures at any time without prior notice to you. In the event of a change, we will post the changes to our website.
5. Indemnification
You agree to fully indemnify, defend, and hold the Styldod Entities and their directors, officers, employees, consultants, and other representatives, harmless from and against any and all claims, damages, losses, costs (including reasonable attorneys' fees), and other expenses that arise directly or indirectly out of or from: (a) your breach of any part of this Agreement; (b) any allegation that any materials you submit to us or transmit to the Styldod Website infringe or otherwise violate the copyright, patent, trademark, trade secret, or other intellectual property or other rights of any third party; (c) your activities in connection with the Styldod Website or other websites to which the Styldod Website is linked; and/or (d) your negligent or willful misconduct.
6. Amendments
We may revise and update our fee schedule and Terms from time to time at our sole discretion. We will notify you of any revisions and updates by posting them to the website. All changes are effective immediately when we post them, and apply to all access to and use of the Services thereafter. Your use of the Services following any such change constitutes your agreement to be bound by the modified fee schedule and Terms. If you do not agree to the revisions, you should stop using the Services. These Terms will identify the date of the last update. As we will be continually improving the Services and adding more features, you are expected to check this page each time you access the Services so you are aware of any changes, as they are binding on you.
7. Consequences of Violating These Terms
We reserve the right to suspend or terminate your account and prevent access to the Service for any reason, at our discretion We reserve the right to refuse to provide the Service to you in the future Styldod may review and remove any of Your Content at any time for any reason, including activity which, in its sole judgment: violates the Term; violates applicable laws, rules, or regulations; is abusive, disruptive, offensive or illegal; or violates the rights of, or harms or threatens the safety of, Users of the Service You are responsible for any claims, fees, fines, penalties, and other liability incurred by us or others caused by or arising out of your breach of the Term and your use of the Service.
8. Miscellaneous
You may not assign any of your rights in these Terms, and any such attempt is void, but Styldod may assign its rights to any of its affiliates or subsidiaries, or to any successor in interest of any business associated with the Services. Styldod and you are not legal partners or agents; instead, our relationship is that of independent contractors.
9. Changes to these Terms
We may change or modify these Terms by posting a revised version on the REimahineHome website, or by otherwise providing notice to you, and will state at the top of the revised Terms the date they were last revised. Your continued use of the Services after any change means you agree to the new Terms.
Acceptance of these terms
You acknowledge that you have read this Agreement and agree to all its terms and conditions. By using the Website or its Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Website and its Services.
